Karen Terms of Use

These terms govern the use of the Android app Karen, the personal voice assistant developed by Starlyware. Please read them carefully: by installing or using the app you accept them. If you do not accept them, do not use the app.

  1. Who We Are and Definitions. Karen (the “App”) is provided by Starlyware di Gianluca Grasso, Chieti (CH), Italy (“Starlyware” or “we” or “us”). “You” or the “User” means the person who uses the App. These terms (the “Terms”) are a contract between you and Starlyware. Your personal data are processed according to the Karen privacy policy available at https://www.starlyware.com/products/karen/privacy (the “Privacy Policy”). These Terms do not limit the rights you have under the Privacy Policy or under data protection law.

  2. What Karen Is and Who Can Use It.

    1. Karen is a personal assistant with a character of her own: she understands everyday sentences, helps you use your phone (calls, messages, alarms, weather, apps and more), remembers a few things about you and keeps you company with games, jokes and stories.

    2. Handwritten answers. Karen does not use artificial intelligence: her answers are written by hand and chosen by rules. She can misunderstand you, answer something unexpected or not know the answer. Her jokes, opinions, tastes and easter eggs are part of a fictional character and are meant for entertainment.

    3. Age. The App is intended for users aged 13 and over. Younger children should use it together with a parent or guardian, who is responsible for their use of the App.

  3. License. We grant you a personal, limited, non-exclusive, non-transferable and revocable license to install and use the App on your devices, for personal and non-commercial purposes, in accordance with these Terms and with the terms of Google Play.

  4. Actions on Your Phone.

    1. You stay in control. When you ask Karen to call someone, send an SMS, a WhatsApp message or an email, share your position, navigate or open an app, Karen prepares the request and opens the right app. Calls and messages are sent only when you confirm them in that app: check the recipient and the text before confirming. You are responsible for the messages you send and for the costs of your mobile plan.

    2. Contacts and names. Karen looks for contacts by name and may choose the wrong one when names are similar. Always check who you are calling or writing to.

    3. Alarms, timers and reminders. Alarms and timers are created in your phone's clock app, and reminders and birthday wishes depend on notifications and on the battery settings of your phone. Do not rely on Karen alone for important appointments, medicines or anything where a missed reminder could cause harm.

    4. Other apps and websites. Searches, Wikipedia, YouTube, translations, maps, music and the other apps and websites that Karen opens belong to third parties and are governed by their own terms.

  5. Emergencies and Health.

    1. Karen is not an emergency service. If you are in danger, call the emergency number of your country (112 in Europe, 911 in the United States and Canada) directly. When you talk about an emergency, Karen shows a button that opens the phone app with the emergency number, but the number she suggests may not be the right one for where you are.

    2. If Karen recognizes that you may be at risk of harming yourself, she shows the numbers of support services. These are a reminder and do not replace professional help: if you are struggling, please talk to someone you trust or to a professional.

    3. Nothing that Karen says is medical, psychological, legal or financial advice.

  6. Weather and Other Information. Weather forecasts come from MET Norway and are automatic: they may be wrong, especially in the mountains. Calculations, conversions, dates, fun facts and the other information given by Karen are provided for general information and may contain errors. Check important information with an official source.

  7. Never While Driving. Do not use the App while driving, cycling or in any situation that requires your full attention. If you are driving, use only the hands-free systems allowed by the law of your country.

  8. Your Data and the Google Drive Backup.

    1. What Karen remembers about you is saved on your phone. You can see it and erase it at any time in the settings of the App.

    2. Backup. The backup on Google Drive is optional and is saved in your own Google account, under the terms of Google. We take reasonable care in making the App work correctly, but we cannot guarantee that your data will never be lost: if a backup or a restore fails, Karen's memory may have to be rebuilt by talking to her again.

  9. “Support the Developer” Purchase.

    1. Voluntary contribution. The App is free. The “Support the developer” purchase is a voluntary contribution to the development of Karen and of the other Starlyware apps: it does not unlock any feature, and Karen simply thanks you. You can make it more than once.

    2. Payments. Payments are processed by Google Play under its own terms. Prices are shown in the App before the purchase.

    3. Refunds. The contribution is digital content delivered immediately. Refunds are handled according to the Google Play refund policy and to the consumer laws that apply to you.

  10. Third-Party Names and Trademarks. Karen is an independent app. The names of films, characters, video games, books, apps, assistants and companies that Karen mentions in her answers and easter eggs belong to their owners and are used only to refer to them, with short quotations for commentary and entertainment. Karen is not affiliated with, sponsored or endorsed by any of them. Google, Google Play, Google Drive, Android, WhatsApp and the other names of services mentioned in the App are trademarks of their owners.

  11. Acceptable Use.

    You agree not to:

    1. use the App for unlawful purposes or in violation of these Terms;

    2. use the App to harass, threaten or deceive other people, for example by sending messages they do not want;

    3. try to bypass the security measures of the App or of the services it uses, or overload them with automated means;

    4. decompile, copy, modify, distribute or create derivative works of the App, its texts or its graphics, except where the law expressly allows it.

  12. Intellectual Property. The App, its code, the texts of Karen's answers, her face, the graphics and the Karen and Starlyware names and logos belong to Starlyware or to its licensors and are protected by the law. If you believe that content in the App infringes your rights, write to us at the address below and we will examine your request promptly.

  13. Changes to the App and Termination. We may modify, update or discontinue the App, or some of its functions, at any time; when possible we will give notice in the App. Some old versions may stop working with the update check and ask you to update. You can stop using the App at any time by uninstalling it.

  14. WARRANTY AND LIMITATION OF LIABILITY.

    1. The App is provided free of charge, “as is” and “as available”. We do our best to keep it working, but we do not guarantee that it will be free of errors or interruptions, that it will understand every request or that the information it gives will be accurate, complete or up to date.

    2. To the extent permitted by law, Starlyware is not liable for indirect or consequential damages, loss of data, missed calls, messages, alarms or reminders, costs of your mobile plan, or damages resulting from the use of the information given by the App or from services, apps and websites of third parties.

    3. Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, such as liability for death or personal injury caused by negligence, for fraud or gross negligence, or the mandatory rights you have as a consumer.

  15. Changes to These Terms. We may update these Terms, for example for new functions of the App or changes in the law. The date of the last update is shown at the top. In case of important changes we will let you know in advance in the notes of the App update on Google Play. If you continue to use the App after the changes, you accept the new Terms; if you do not accept them, you can stop using the App and uninstall it.

  16. Applicable Law and Disputes. These Terms are governed by Italian law. If you are a consumer, you keep the protection of the mandatory rules of the country where you live, and you can bring proceedings before the courts of your place of residence.

    Before going to court, write to us: most problems can be solved quickly by email. If a clause of these Terms is invalid, the other clauses remain in force. These Terms are the complete agreement between you and Starlyware about Karen: the general Starlyware terms of use do not apply to the App.
