Introduction. Welcome to Starlyze ("Starlyze", "Service", "App"), a mobile community platform created for amateur astronomers, astrophotography enthusiasts, sky gazers, and observers of unidentified aerial phenomena (UAP), developed and operated by Starlyware di Gianluca Grasso, Chieti (CH), Italy ("Starlyware", "Company", "we", "us", "our").
By registering for, downloading, installing, or accessing Starlyze, you acknowledge that you have read, understood, and agreed to be bound by these Terms of Use ("Terms"), which constitute a legally binding agreement between you ("you", "User") and Starlyware. These Terms apply to all users, regardless of registration mode, including direct registration via email or third-party OAuth providers such as Google Identity.
Your personal data are processed according to the Starlyze privacy policy available at https://www.starlyware.com/products/starlyze/privacy (the "Privacy Policy"). These Terms do not limit the rights you have under the Privacy Policy or under data protection law. These Terms are the complete agreement between you and Starlyware about Starlyze: the general Starlyware terms of use do not apply to the App.
If you do not agree to these Terms, you must not access or use Starlyze and must immediately delete the application from your devices.
Eligibility and Age Requirements. Starlyze is intended exclusively for individuals who are at least 16 years of age (or the minimum age of digital consent required in your country of residence within the European Union or other jurisdictions). By creating an account, you represent and warrant that you meet this minimum age requirement.
If we discover or reasonably suspect that an account belongs to an individual under 16 years of age, we reserve the right to immediately terminate the account and erase all associated personal data without notice. Parents or legal guardians who become aware of an unauthorized registration by a minor may notify us at info@starlyware.com for swift account deletion.
Account Registration and Security. To access the social and interactive features of Starlyze, you must register by providing a valid email address, a unique username, and a password, or via a supported Google account. You agree to provide accurate, current, and complete information and to keep your credentials up to date.
Usernames must comply with our formatting rules (lowercase alphanumeric characters and underscores, between 3 and 30 characters) and must not infringe on third-party intellectual property, trademarks, or contain offensive or impersonating terms.
You are solely responsible for maintaining the confidentiality of your login credentials and for any activity carried out under your account. You agree to notify Starlyware immediately at info@starlyware.com in the event of any suspected security breach or unauthorized access.
Description of the Service. Starlyze provides tools and social features dedicated to astronomy, astrophotography, dark-sky stargazing, and sky observation, including:
Voluntary Geolocation. Starlyze allows users to optionally attach geographic coordinates (via GPS or manual input) to observation posts and Dark Sky Spots. To protect personal privacy, automated GPS capture may be approximated (geohash encoding). You must never disclose precise coordinates of private residences or sensitive properties.
Outdoor Safety and Physical Risks. Dark Sky Spots and observation sites submitted by users or third parties often involve remote, mountainous, unlit, or rugged terrain. Starlyware does not inspect, verify, police, or guarantee the physical safety, accessibility, legality, road conditions, or private property boundaries of any location displayed in the App.
User Responsibility. Visiting any observation site, stargazing location, or traveling in remote areas is conducted entirely at your own risk. You are solely responsible for respecting local laws, trespassing regulations, weather forecasts, proper gear, and personal safety. To the extent permitted by law (see Section 11), Starlyware is not liable for injuries, property damage, accidents, or legal disputes arising from visits to locations found via the Service.
Ownership and License. You retain full ownership of all images, technical data, comments, messages, and texts you submit to Starlyze ("User Content"). By uploading User Content, you grant Starlyware a worldwide, non-exclusive, royalty-free license to store, display, optimize, and distribute your content to other users exclusively for the operation of the Service, according to the visibility of the content (for example, public posts are visible to all users, messages only to their recipients). Starlyware may use technical providers (such as Google Firebase) to host the content on its behalf. We will not use your User Content in advertising or marketing outside the App without your separate consent. This license terminates when you delete your content or account, except for copies that other users have already received in conversations and for comments kept in anonymized form as described in Section 8.
Prohibited Content. You agree not to post, publish, or transmit any User Content that:
Notice and Action Mechanism (EU DSA). Starlyze acts as an intermediary hosting service provider under the European Union Digital Services Act (Regulation EU 2022/2065). Starlyware does not engage in general, proactive monitoring of all User Content. However, Starlyze implements a zero-tolerance policy against illegal and harmful material. Users can report any post or Dark Sky Spot directly using in-app report buttons; anyone, including non-users, can also report illegal content by email to info@starlyware.com, which is also our single point of contact for authorities and users under the DSA. We review reports in a timely, diligent and objective manner and, where appropriate, take corrective action (content removal, disabling access, suspension or banning of violating accounts). When we remove content or restrict an account, we inform the affected user of the decision and of its reasons, unless the law prevents it, and the user can reply to contest it. Decisions are taken by a person, not by automated systems.
Scientific and Community Disclaimer. Content shared in Starlyze reflects individual amateur observations and community discussions. Credibility voting and sighting reports represent collective user perceptions and do not constitute certified scientific validation, governmental endorsement, or official astronomical proof.
Private Messaging and Code of Conduct. Direct messages between users are designed for cordial discussion, astrophotography techniques, and astronomy collaboration. You are strictly prohibited from using private messages to stalk, harass, solicit commercial transactions, send unsolicited promotional messages, or distribute abusive media. Users may block unwanted contacts at any time using the blocking features, which instantly prevent message exchange and profile viewing.
Account Deletion and GDPR Compliance. In accordance with the EU General Data Protection Regulation (Regulation EU 2016/679), you have the right to terminate your account and request the erasure of your personal data at any time, directly through the App via Profile > Edit Profile > Delete My Account.
When you trigger account deletion via our automated system:
Account deletion is final, automated, and irreversible. Some data may be kept for a limited time where required by law or to protect against abuse, as described in the Privacy Policy.
Starlyware Intellectual Property. All interfaces, software architectures, algorithms, logos, graphical assets, custom vector designs, and application source code associated with Starlyze are the exclusive intellectual property of Starlyware di Gianluca Grasso. You are granted a personal, non-commercial, revocable, and non-exclusive license to use the Starlyze mobile client on your personal Android device.
Third-Party Services and APIs. Starlyze integrates third-party technologies and public APIs, including:
These services operate under their respective privacy policies and terms. Starlyware is not responsible for the continuous uptime, rate limits, or content policies of third-party API providers.
"As Is" Basis: Starlyze is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted availability.
Limitation: To the maximum extent permitted by applicable law (including mandatory consumer protection provisions under European Union law), Starlyware and its owner shall not be liable for any indirect, incidental, special, consequential, or punitive damages, loss of profits, loss of data, property damage, or hardware malfunctions resulting from your access to, use of, or inability to use Starlyze, or your reliance on any user-generated content or map location.
Mandatory Rights: Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, such as liability for death or personal injury caused by negligence, for fraud or gross negligence, or the mandatory rights you have as a consumer.
Account Suspension and Termination. Starlyware may suspend, restrict, or permanently terminate your access to Starlyze, where possible after a warning and always informing you of the reasons, if you violate these Terms, engage in harassment or illegal activity, manipulate credibility systems, abuse report mechanisms, or if required to do so by judicial authorities.
Governing Law and Jurisdiction. These Terms shall be governed by and construed in accordance with the laws of Italy, without regard to conflict of law principles. If you are a consumer residing within the European Union, you also benefit from the mandatory consumer protection provisions of your country of residence.
If you are a consumer, disputes are decided by the courts of your place of residence or domicile. In all other cases, the competent court of Chieti, Italy has exclusive jurisdiction. Before going to court, write to us: most problems can be solved quickly by email.
Miscellaneous and Contact Information.
Modifications: Starlyware may update these Terms periodically. The date of the last update is shown at the top. In case of important changes we will let you know in advance, before they take effect, by email (if you have an account) and in the notes of the App update on Google Play. If you continue to use Starlyze after the changes, you accept the new Terms; if you do not accept them, you can stop using the App and delete your account.
Severability: If any provision of these Terms is held invalid or unenforceable, the remaining provisions will continue in full force.
