StarlyLab Terms of Use

These terms govern the use of the Android app StarlyLab, the science laboratory in your phone, developed by Starlyware. Please read them carefully: by installing or using the app you accept them. If you do not accept them, do not use the app.

  1. Who We Are and Definitions. StarlyLab (the “App”) is provided by Starlyware di Gianluca Grasso, Chieti (CH), Italy (“Starlyware” or “we” or “us”). “You” or the “User” means the person who uses the App. These terms (the “Terms”) are a contract between you and Starlyware and also apply when you sign in with Google. Your personal data are processed according to the StarlyLab privacy policy available at https://www.starlyware.com/products/starlylab/privacy (the “Privacy Policy”). These Terms do not limit the rights you have under the Privacy Policy or under data protection law.

  2. Who Can Use StarlyLab.

    1. StarlyLab is an educational app designed for high school and university students, teachers, makers and science enthusiasts.

    2. Account and age. The instruments and the notebook can be used without an account. An account can be created by users aged 14 or over. Users under 14 (or under the age of digital consent of their country, if different) may create an account only with the consent of a parent or guardian.

    3. Minors. If you are a minor, a parent or guardian is responsible for your use of the App and should supervise your experiments.

    4. Schools. Teachers and schools may use the App in class, under their own responsibility for the supervision of the students.

  3. License. We grant you a personal, limited, non-exclusive, non-transferable and revocable license to install and use the App on your devices, for personal and educational purposes, in accordance with these Terms and with the terms of Google Play. Use in a school or classroom is considered educational use. Any other commercial use requires our written permission.

  4. Account.

    1. The account is optional: it is used for points, badges and the AI tutor.

    2. Your information. The information you give us must be true and up to date. Keep your password confidential: you are responsible for what happens with your account. If you think someone else is using it, write to us immediately.

    3. Deletion. You can delete your account at any time, from the app or as explained on the account deletion page: https://www.starlyware.com/products/starlylab/delete-account.

  5. Your Notebook and Your Content.

    1. Your notebook. The lab notebook (experiments, measurements, recordings, photos, reports) is saved only on your phone. It belongs to you: we do not receive it and we claim no rights over it.

    2. Backups. You are responsible for your backups. If you lose or reset your phone, or uninstall the App, the notebook is lost unless you have made a backup (Google Drive or file). We cannot recover it.

    3. Profile. The name and the photo of your profile are stored on our servers only to show them to you in the App. You grant us the license strictly necessary to store and display them for this purpose. Do not use names or photos that are offensive, that infringe the rights of others or that contain personal data of other people.

    4. AI tutor. When you use the AI tutor, the text of the page you choose is processed only to answer you (see Section 7).

  6. Measurements and Instruments.

    1. Not calibrated. The instruments of StarlyLab use the sensors of your phone, which are not calibrated or certified measuring instruments. The results can be approximate and vary from one phone to another.

    2. Educational use only. The App is meant for learning and experimenting. Do not use its measurements for safety, medical, legal, professional, engineering, navigation or any other decision where an error could cause harm.

    3. Heart rate. The heart rate instrument is an educational experiment, not a medical device. It does not diagnose, prevent or treat any condition. If you have health concerns, ask a doctor.

    4. Sound level meter. It is not a certified sound level meter and must not be used to assess the safety of a workplace or of hearing.

    5. Geological compass and level. They are not suitable for navigation, surveying or construction.

    6. Earthquakes and space weather. The data come from public services and may be delayed or incomplete. StarlyLab is not an alert system: in an emergency follow the instructions of the civil protection and of the competent authorities.

  7. AI Tutor.

    1. Automatic answers. The answers of the tutor are generated automatically by an artificial intelligence model (Google Gemini). They may contain mistakes, be incomplete or not suitable for your situation: always check them, with the help of a teacher when possible.

    2. Not a substitute. The tutor helps you reason about your experiment; it is not a substitute for a teacher and does not give medical, legal or safety advice.

    3. What you send. Do not write personal data, data of other people or inappropriate content in the pages you send to the tutor. Do not use it to produce content that breaks the law or these Terms.

    4. Limits. The number of daily questions is limited. Extra questions may be available by watching optional ads. We may change the limits or suspend the tutor at any time. You can report an inappropriate or wrong answer with the “Report” button: we review the reports.

  8. Safety of the Experiments.

    The experiments are carried out at your own risk and under your responsibility (or of the adult who supervises you). In particular:

    1. children and young people should do experiments under the supervision of an adult;

    2. read and follow the safety notes of each guided experiment, and stop if something seems dangerous;

    3. protect your phone: use strings that cannot break, soft surfaces below and never put the phone at risk of falling, getting wet or overheating;

    4. never look directly at the Sun, not even with filters that are not certified for solar observation;

    5. keep the volume moderate, especially with headphones and high frequencies;

    6. keep strong magnets away from pacemakers, payment cards and electronic devices;

    7. use only safe, household substances (such as water and food colouring), do not taste or mix chemicals, and follow the instructions of an adult or a teacher;

    8. outdoors, respect private property, nature, traffic rules and local laws; on rocks and slopes pay attention to where you put your feet;

    9. do not do physical exercise if you have health problems.

    Starlyware is not responsible for damage to people, animals, things or devices resulting from the way the experiments are carried out, within the limits allowed by law (see Section 15).

  9. Points, Levels and Badges. Points, levels and badges are a game to motivate learning. They have no monetary value, cannot be sold, exchanged or transferred, and do not give rights to prizes. We may change the rules, add or remove badges, and remove points or badges obtained by cheating or by manipulating the App or its data.

  10. “Support the Developer” Purchase.

    1. Voluntary contribution. The App is free. The “Support the developer” purchase is a voluntary contribution to the development of StarlyLab: it gives you the “Supporter” badge and does not unlock additional features.

    2. Payments. Payments are processed by Google Play under its own terms. Prices are shown in the App before the purchase.

    3. Refunds. The contribution is digital content delivered immediately. Refunds are handled according to the Google Play refund policy and to the consumer laws that apply to you. If a purchase is refunded or cancelled, the Supporter badge is removed.

  11. Advertising and Third-Party Services. The App shows ads provided by Google AdMob, including optional rewarded videos. We are not responsible for the content of the ads or for the products and services of the advertisers.

    The App uses data and services of third parties (for example USGS, INGV, NOAA, MET Norway, wheretheiss.at, Google) and may contain links to external websites and apps: they are provided “as is” and are governed by their own terms. Data sources and their licenses are listed in the “About StarlyLab” screen.

  12. Acceptable Use.

    You agree not to:

    1. use the App for unlawful purposes or in violation of these Terms;

    2. try to gain unauthorized access to the App, to our servers or to other users' accounts, or to bypass its limits and security measures;

    3. overload our services, use bots, scripts or automated means to access them, or use modified versions of the App;

    4. decompile, copy, modify, distribute or create derivative works of the App, except where the law expressly allows it;

    5. use names, photos or texts that are offensive, illegal or that infringe the rights of others.

  13. Intellectual Property. The App, its code, graphics, texts, guided experiments and the StarlyLab and Starlyware names and logos belong to Starlyware or to its licensors and are protected by the law. Third-party data and content (for example scientific data under CC BY 4.0 or in the public domain, Natural Earth map data) remain subject to their own licenses.

  14. Suspension and Termination. You can stop using the App and delete your account at any time.

    We may suspend or delete accounts that seriously or repeatedly breach these Terms or the law, or that put the security of the service or of other users at risk. We may modify or discontinue the App, or some of its functions, at any time; when possible we will give notice in the App.

    Your notebook stays on your phone even if the account is closed.

  15. WARRANTY AND LIMITATION OF LIABILITY.

    1. The App is provided free of charge, “as is” and “as available”. We do our best to keep it working and accurate, but we do not guarantee that it will be free of errors or interruptions, or that the measurements, data and answers will be accurate or complete.

    2. To the extent permitted by law, Starlyware is not liable for indirect or consequential damages, loss of data (including the notebook), or damages resulting from the use of the measurements, of the tutor's answers or from the way the experiments are carried out.

    3. Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, such as liability for death or personal injury caused by negligence, for fraud or gross negligence, or the mandatory rights you have as a consumer.

  16. Changes to These Terms. We may update these Terms, for example for new functions of the App or changes in the law. The date of the last update is shown at the top. In case of important changes we will let you know in advance, before they take effect, by email (if you have an account) and in the notes of the App update on Google Play. If you continue to use the App after the changes, you accept the new Terms; if you do not accept them, you can stop using the App and delete your account.

  17. Applicable Law and Disputes. These Terms are governed by Italian law. If you are a consumer, you keep the protection of the mandatory rules of the country where you live, and you can bring proceedings before the courts of your place of residence.

    Before going to court, write to us: most problems can be solved quickly by email. If a clause of these Terms is invalid, the other clauses remain in force. These Terms are the complete agreement between you and Starlyware about StarlyLab: the general Starlyware terms of use do not apply to the App.
